The 33-year-old appeared in court today after allegedly punching his brother Patrick in the head following a minor disagreement outside a Sydney nightclub.
Patrick Lyttle woke up and is sitting up in bed, almost a week after the attack.
Their father Oliver said it is great that Barry Lyttle is out of police custody.
