THE GOVERNMENT has published a slimmed-down version of its website on the Children’s Rights referendum, after this morning’s Supreme Court ruling – and amended the text of the revised website after it emerged that the text published on it was incomplete.
The Supreme Court this morning ruled that the ChildrensReferendum.ie website published by the government in September was in breach of the terms of the 1995 McKenna ruling – in that it contained language which implicitly advocated a Yes vote in Saturday’s referendum.
The website was taken offline within an hour of that ruling being published, and was this evening restored with most of its content removed – containing only the text of the proposed new article 42A, which would be inserted into the Constitution if Saturday’s vote is passed.
However, the text displayed on the website upon its return this evening was not a complete version of the referendum text being put to the public – as the single-page website had omitted a reference to the proposal to delete a section of another Article elsewhere in the document.
The edition of the website which returned this evening – shown in the image above – did not include a reference to the proposal which would see Article 42(5), dealing with the removal of a clause which is superseded by a portion of the new text.
Alongside the inclusion of a new Article 42A, the proposal being put to voters on Saturday also includes the removal of Article 42(5), which already provides that the State shall “endeavour to supply the place of the parents” if the parental role is not being fulfilled by the child’s own parents, though always “with due regard for the natural and imprescriptible rights of the child”.
Though this clause is superseded by the provisions being included in the new Article 42A, the wording of the new article is slightly different – in that it removes a clause which says the State can only exercise this role if the child is being failed for “physical or moral reasons”.
This was not referenced on the new website when it first appeared this evening – and only appeared after the replaced website was amended at about 9pm this evening.

@Teresa O’Donnell: It tries to do everything, chat show, music show (county music – shudders), current affairs, competitions, etc, it’s a tired format that isn’t needed as other shows have what they try to do very badly done much better. For it to work going forward it just needs to be a chat show and a light hearted one at that, copy what others do in the UK and US. Keep the name but that about it.
@Teresa O’Donnell: and most of the “celebs” who grace the Late Late need to constantly promote their meagre talents to stay in the public eye. Perhaps RTE should be charging them for using the public funded airwaves?
@Jason Walsh: But that’s exactly what Turbidy did – turned it into “ight” entertainment with the odd sad story thrown in for good measure, and he ruined it. If that’s the type of show people want to watch then switch channels and watch Graham Norton or Johnathon Ross.
RTE in poor light lol that ship has long since sailed.

@Jason Walsh: Hearsay – I could say I know the man personally, doesn’t make it true. I have, however, had the pleasure of dealing with him when I was a manager in Jury’s Hotel and found him to be a very pleasant individual. I think you may have him mixed up with Brendan O’Connor
@Shane Lad: Marty is great and his Lyric FM show runs from 7 in the morning until 10 so he does a job, Mr. Its the only radio show i can stand, my only gripe is the constant AA roadwatch updates.
Dustin the turkey would be a fine replacement.
It should have been retired after Pat Kennny, inane chatter with guests to match. €160 wasted imo.

Is it just me, or does anyone else think this is being blown out of all proportion? Saw some lad comment on this over the weekend saying there should be a public enquiry!
@honey badger: if it is the same comment I saw, considering the context of the posts around it, I think the person advocating for a public enquiry was being sarcastic to be honest.
Haven’t watched the Late Late show in years..Since Gay Byrne packed it in. Personally couldn’t stand him the way he treated some guests if it didn’t suit his narrative. In saying that credit was due to him for raising topics that brought to light the hypocrisy of Church and State. What I now find interesting is the overpaid so call presenters who now seen to run a mile rather than take the job…A kiss of death.
I would like to see Katie Hannon hosting the Late Late Show.

Rte is pure rubbish , the news doesn’t even report the news , these mediocre presenters get paid far too much , I’ve seen more talent on tictok ! Tax payer forced to pay a corrupt organisation is insane
