Prime Time ‘reveals section of Expert Group report on abortion’

It said that its recommended options to implement the European Ruling in the case of A, B and C versus Ireland include primary legislation or guidelines.

RTÉ’S PRIME TIME says it has seen a section of the government’s Expert Group report on how to implement the European Ruling in the case of A, B and C versus Ireland.

The show’s reporter Oonagh Smyth said tonight on Prime Time that she has see part of the report, which is due to go before cabinet next week.

She said the report has a number of options, including primary legislation; the issuing of guidelines without primary legislation; legislation alone; or legislation plus regulations.

The report is believed to be very negative towards the options that do not include legislation.

The report will be published next Tuesday and will be discussed in the Oireachtas before the Government makes its decision on the issue.

ULA TD Clare Daly and Fianna Fáil Senator Jim Walsh spoke on Prime Time about the issue.

Walsh said he was not surprised and that anything short of legislation would be problematic. He said it will depend on the shape of the legislation as to whether it would be defeated or not.

Deputy Daly said that she thinks that there would not be an issue with legislation being passed on foot of this report, adding: “We will see if the Government are going to stick to their word and provide that legislation”. Daly is to introduce a bill on legislating for the X Case as an “interim measure” next week.

    Not much in the way of new options is it? The above choices have been available to us for the last 20 years and have gone ignored.

  • If the leaked elements of the Report are accurately stated, there is no reference to the repeal of article 40.3.3 of the Constitution, the Eight Amendment in 1983. That possible option was not likely within the remit of the Report. Article 40.3.3 is the root cause of this crisis which has very likely been the reason why life saving medical treatment had to be withheld from Savita and possibly, even likely, from other women.

    The only clean, safe, sensible and truly democratic way to address this legal quagmire is to hold a Referendum and to permit the people, if they so wish, to repeal a pernicious Constitutional provision which should never have been put to the people in the first place.

  • This “leak” could only have come from Minister Reillys office…..or from the Tanaistes or the Taoiseachs office.I’m sure their Cabinet colleagues are chuffed with another “leak”…like when James’s Hospital was picked days before that report came to cabinet….shoddy way to run a government…like we needed another example!! :(

    • The DEPT Of Health has become a disaster area. It was really bad with Ms Hearney but NITHING like it has become with Reilly we are getting third world service for 1st class payments 100euro just to sit in a waiting room for hours on end just. To be seen by a doctor and if you are unfortunate to be admitted well if you. Get. A bed within twenty-four hours wow you are either. Very very lucky or you are unfortunately very very sick. And as for the leaks well that is the caliber of the people that are running our country Useless shower of failures at everything they. Ever worked at and show no respect or confidentiality to anyone of us HOW. tell me can anyone have faith with Reilly,
      Kenny and all of the cabinet And as for Gilmore what a shower of moppets we have at the Helm……

  • The leaks given to RTE demonstrate how close the media are to politicians. It means they trade favours and can’t act objectively. Not once have we seen any politician in the past 10 years been shown to have had an affair. Some are married to politicians or relatives which makes it impossible to believe what deals are being done and what news is true. I think to keep their jobs journalists are compromising themselves. By all accounts the politicians don’t have affairs, don’t have any interest in sex outside their marriages , don’t take drugs, don’t behave illegally around money etcetc. Our TDs must be saints as none of them ever get caught with their pants down or misbehaving like their European counterparts.

    • In fairness I don’t think the public really care if a politician is sleeping with the neighbour … and the postman, or wears Y-fronts instead of boxers.
      People are more concerned about what is being done to sort out the various messes we’re in.
      The leaks show lack of courage on the government’s part. It doesn’t inspire confidence when these are the methods employed to inform the public – no matter how unpopular or sensitive the subject. The government shows lack of strength when they don’t prove responsibility and accountability when (and by) communicating with the public. The media it seems are enabling it and in collusion – no guts or balls resulting in lack of respect to both.

  • now is the time for action. the government must make up for past failures and pass legislation. now is not the time to give in to pro life scaremongering. it’s too important. ireland has to stop exporting its problems to england.

    • Why doesn’t Enda grasp the nettle and run with it. Make a name for himself for posterity. Be the leader who got the appropriate effective legislation thru the Dail. Get cross party agreement to throw off all party whips and go for it. Throw the spotlight on the legislature. See what the elected lads and lassies in the chamber are really made of. Can they be people of real substance or remain people of straw?
      He has nothing personally to lose. This would be much more significant than a cv that reads over forty years in the Dail and Taoiseach and leader of his party in terrible times. Why not be the Taoiseach who enacted the most difficult and far reaching legislation on this emotive issue and remove the tragically farcical situation that pertains at present.
      Polish the cocones Enda. Get out the Brasso.
      I won’t be holding my breath.

    • @ Peter great sentiments there but Kenny needs to be taken by the hand at every turn He needs his speech in front of him before he speaks and if anyone asks him a question he needs thee answer in front of him also that is why Kenny never gives an . He is the biggest Muppet of them all.Kenny is a pure Disgrace to the Electoret ever

    I think it’s safe to say it’s contents are irrelevant. the politicians will do whatever they want to save their own skins.

    If they legislate, it will be because sunshine run died because of their previous failure to do so, not because the report recommended it.

    • So is the inability to use the spacebar … well if you’re going to be pedantic about the work of others at least make sure your own is up to scratch!

      On the matter at hand, this should be put to the people to decide, not a government who are dancing around the issue. If they can’t make the decision then at the very least give us the chance to have our say!

  • What exactly does introducing an already failed bill as an “interim measure? mean Clare Daly? Or is this just about providing some further column inches for the bould Clare?
