People have lost years of their lives in Direct Provision - here is how it could end

The Minister for Justice Frances Fitzgerald has called for a streamlining of the system

IRELAND’S DIRECT PROVISION system that has seen asylum seekers lose years of their lives could be set to change.

Minister for Justice France Fitzgerald has said that it is now the aim of the government to streamline the current system and make it so that cases are dealt with in a period of six months to a year.

Speaking on RTÉ Radio’s This Week programme, she said, “[The] system need to be more effective and efficient. Unlike the rest of Europe we have a very complicated system with many levels.”

This follows the publication of a report by a working group into the asylum and protection process offered in Ireland.

The nexus of the report was that no person should have to remain in the Irish Direct Provision system for more than five years.

The minister stated that these extensive delays are down to the complicated system that exists in Ireland which involves five layers of processing, creating the possibility for five judicial reviews. The aim is to cut this down to two.

More than 3,600 asylum seekers are currently in Direct Provision centres around Ireland with 1,500 of these having been in the system for more than 5 years.

Direct Provision accommodation has been a feature in Ireland for the past 15 years. In May, it was found that one individual had been living within the system for 11 years.

In a statement this afternoon, the Irish Human Rights and Equality Commission has issued a statement urging the implementation of the working group’s recommendations.

Chief commissioner of the group, Emily Logan, said, “The introduction of a time limit of 12 months for decisions on protection status, along with the right to work for new applicants if a decision is not made within nine months, forms the overarching recommendations of the working group report.”

Fitzgerald went on to say that the country requires a fair asylum assessment system that is also “rigorous” and that will send individuals who do not meet the required criteria back to their countries of origin.

On the potential for an increase in deportations as part of the introduction of a new system, she said:

Many people say you should have a strict system, and yet when they hear about individual cases, they always want to make the individual case for the particular circumstances.
I think what we need to have in place is a system that is quick, that is efficient, that is fair, but equally, if people come illegally into this country, they should not be allowed to stay.

    And what happens if they’re unsuccessful in their applications after 6-12 months? If you keep avoiding deporting people you’ll keep having the same problems but under a differently name.

    The 7 people that wandered into immigration control after getting off the inaugural flight of Ethiopian Airlines from Addis Ababa were apparently able to get on the flight with no passports or no travel documents. They just wandered on to a Boeing 747 in a country bordered on all sides by an assorted bunch of Islamists and war criminals .

    No one down my local would take a bet that this would happen, not one person because they knew that they would lose. No one would take a bet that instead of being held in secure holding until their true identity is verified, they will instead be put into direct Provision with no one to stop them wandering off again. We don’t know who they are, where they are from, what their background is or what their intentions are but don’t worry it’ll be grand!

    At least 94% of applications are rejected, this from a country with a very soft approch to this topic which ought to tell you that most are obviously not legit.

    IMO we should have an annual quota of 100, the 100 most dire cases that can ALSO provide proof of their situation AND their identity can stay, the rest are automatically deported the minute their feet hits the airport or port. We ought to tighten these rules on ‘leave to remain’ as well. I’d keep DP, in a reformed way, if a hostel is barbaric to you then your situation at home was not that bad and you should not be here to begin with

    1 person living in accomadation for 11 years ??? how was this allowed happen they were obviously refusedand appeald MANY times so why have they been let stay for the years following at a cost to the tax payer?? have a fair system ..come apply get accepted or refused and thats the final descision end off !!!

    Good. The problem isn’t so much direct provision as the length of time people have to wait, which benefits nobody.

    Either someone is entitled to be here or they’re not, decide and move on.

    @ Ray..Don’t people understand there is almost no asylum process it’s now a resettlement process, if tomorrow we closed ALL the DP centres tomorrow, we will still have to feed, clothed, house, educate, transport, doctor, these people almost none will be sent home!

    Bill we have nearly 5000 people homeless in ireland not one of those is an illegal immigrant so find out where they are from and send them home as soon as possible.

    this must be the 7th or 8th article on this issue over the past week! give it a rest. you Ireland, now have over 400 homeless families in Dublin at the moment, and with that comes over 1,000 children… sort it out! – ffs! your priorities are all wrong.

    as regards asylum seekers i dont want to hear or read anymore, like everything else in this country the whole system is a joke! the rich will benefit and its left to other to clean up the mess!

    Another anti direct provision article. Seriously it’s getting ridiculous. I think you’ll find the majority of Irish people are actually in favour of retaining it. Or indeed strengthening it so that those with bogus claims can’t keep appealing to stay in the country.

    besides that i don’t get how one can get work visas for here in any line of work, if they even have work visas at all. it states the contrary on the visa site but yet…

    the amount of countries not requiring it into here is absurd. where are they going to house and school them all? or perhaps they have other plans. unrest?

    Spare a thought for the Solicitors that have become millionaires appealing decisions of illegal immigrants who should of been deported years ago. This is going to affect there easy money making capacity at tax payers expense lifestyles which is very sad. They’ll have to go back to keeping scm bags out of jail on free legal aid for a living.

    whatever the ins and outs of it, keeping anyone in a situation like this is crazy, a waste of taxpayers money and yet another example of the incompetent foot dragging by our elected officials, I’m starting to believe more and more that the present system of government just isn’t fit for purpose, it’s the same old tired faces with the same old rhetoric day after day. what on earth did we do to deserve this. I really believe that if all the Irish people that have emigrated over the last twenty odd years hadn’t been allowed to we’d have a totally different country.

    Could the journal please stop indulging in the fantasy that 10 years in DP is forced on people, and instead stop running away from the fact that multiple appeals are allowed so legal professionals can make a fortune in free legal aid, and DP centre owners can make a fortune renting these centres to the government. You’re fooling nobody.

    One decision either yes to remain or deportation,One appeal in the applicants name including children not multiple claims.
    If decision is to deport they are removed from the state within 48 hrs,Put in place a fine system for the airlines this will cut down on these economic migrants flushing their passports down the toilet.
    And under no circumstances give those in DP or ones with deportation orders against them leave to remain within the state.
    There it is the problem solved.

    Funny how the fg td who stood up in the dail the other day and said she has to budget on her td pay has a daughter who got a social house and when her father died she moved into his house and you would think she gave back the social house but no she’s renting it out for over a 1000 a month and not a word from the journal

    People in Gaelteacht areas are being forced to emigrate and at the same time people in direct provision are wanting to stay here, it is a strange country. We spend Billions annually on Irish yet nobody benefits — how about spending money on creating jobs in these areas and let the locals and the people in direct provision start afresh.
