Australian parliament votes down proposal for same-sex marraige

The government allows MPs to have a free vote in the House of Representatives – meaning a 98-42 defeat.

AUSTRALIA’S PARLIAMENT has voted overwhelmingly to reject gay marriage, after days of heated debate that saw one senator resign from a key role after linking same-sex unions to bestiality.

The House of Representatives voted down the bill to legalise marriage between same sex couples by 98 votes to 42, with Labor prime minister Julia Gillard and opposition conservative leader Tony Abbott both voting against it.

Gillard had allowed Labor MPs a conscience vote on the issue – meaning they were free to vote how they wanted rather than along party lines – while the opposition had opposed it.

Labor frontbencher Anthony Albanese, who voted for the reform, said despite the bill’s failure the figures were encouraging.

“Just a few years ago there wouldn’t have been the support of anything like 42 votes on the floor of the national parliament for a marriage equality bill,” he told reporters.

“All the figures show that there is majority community support on this issue… and I think at some future time, parliament will catch up with the community opinion.”

‘What’s next?’ asks senator

The vote ends several days of debate on the bill, during which one senator sparked outrage by linking same-sex marriage to sex with animals. The furore surrounding the comments forced him to resign from his parliamentary role.

Speaking on the bill last night, outspoken Liberal senator Cory Bernardi said he questioned what the next step would be if the government redefined marriage so that two people could wed regardless of their gender.

“The next step, quite frankly, is having three people or four people that love each other being able to enter into a permanent union endorsed by society,” he told the Senate.

“There are even some creepy people out there… (who) say it is okay to have consensual sexual relations between humans and animals. Will that be a future step?”

Elements within the Liberal Party slammed the comments, including high-profile former leader Malcolm Turnbull who described them as “hysterical, alarmist, offensive”.

Liberal leader Abbott said Bernardi had offered today to resign his position as his parliamentary secretary as a result, and he had accepted this.

New Zealand’s parliament approved legislation allowing same-sex marriage only last month.

  • So according to your strange logic, public policy in this area should be determined by homophobic bullies (no doubt influenced ny the prejudices of adults who should know better) rather than the desire of capable parents to provide a loving home – which is the paramount consideration, not gender or sexuality.

    Schools are increasingly committed to implementing anti-bullying measures, with a focus on the likes of racism and homophobia. This is to be welcomed in a diverse society and will be supported by anyone who is truly interested in child welfare, as opposed to those using them as an excuse to justify anti-gay bigotry.

    • Well said. People really are stupid to the point where it is not even funny. In a Democracy you don’t vote on other human beings rights. If Americans had voted on African-Americans rights in the 1960s, nothing would have changed. Why not then vote on whether to make murder, legal? People need to seriously learn what a Democracy is; you can’t be selective about certain rights and call it a “Democracy”. It’s amazing how many adults can’t comprehend what a Democracy actually is, all they can do is yell “freedom’ like a moron.

  • The more I hear about Australia, the less I feel inclined to visit.

    This is a show of sheer ignorance. I’m blue in the face asking this, but how is it any of our businesses who marries who? As long as everyone is a consenting adult I couldn’t give a rate patootie, and more to the point, it’s absolutely none of my business.

      You could say well at least they voted on it not sure if we’ve progressed that far in Ireland.
      To be honest I think while the vast majority of the under 35 population couldn’t give a fiddlers who marries who but at the same time we underestimate the sizeable proportion of the population here that is strongly against gay marriage. Politicians believe and vote for what they believe is in there best interest.

    • As long as they’re involving nobody else in it, I honestly don’t care (if an incestuous couple were to have a child, it’s be a different story). I might not personally like the idea of incest, but what people get up to in their own home is not my business.

      And homosexuality is nothing, nothing, nothing like incest, as you say John.

      Rory, I absolutely agree and think it’s despicable that we haven’t legalized it here. I truly believe we will look back at this and compare it to the civil rights movement in 1960s America.

  • I think the main issue here (and the reason the marriage motion was defeated)is the one on the horizon, and is the one that is being studiously avoided. Namely equal adoption rights for same sex couples.

    If gay people are given equal marriage status the issue of children comes up straight away. And that’s a very hot potato that no political party wants to face.

    • Not so. Every political party here bar one has endorsed both equal marriage and adoption rights. And single people, regardless of sexuality, can already apply to adopt. The ban on a gay couple adopting then is an anomoly that needs to go. And there are already same-sex couples raising children and it is wrong to deny these families equality under the law.

      As for the vote in Australia, Senator Penny Wong put it very well – This vote may have been lost but the battle continues and the pro-equality argument will certainly prevail in Australia and in the near future too. Meanwhile a number of States and Territories have their own marriage equality bills which stand a much better chance of passing.

    I’m sure the many children being raised by loving same-sex families would gladly support a change in the law so the non-biological parent would have legal responsibilities regarding their welfare. In fact, those situations are far more common than stranger adoption. So again, why should they and their parents be denied equality due to the outdated and prejudiced views of what is a thankfully shrinking minority..Such people need to stop using children as a smokescreen for their anti-gay beliefs.

    And in that ‘real world’ you seem so keen to talk about, many different family units already exist. You are clearly uncomfortable with anyone or anything that does not fit your narrow concepts of what constitutes normal and acceptable, something you have more than demonstrated by your comments on this forum. You also imply that bullying is simply a fact of life which we should just accept. I find that both strange and disturbing.

    But Irish society is becoming more accepting of difference and diversity and that trend is only likely to continue.

  • I really thought Australia was a more progressive place, I knew Gillard was opposed to equal marraige but thought the others would reflect the thoughts of the majority which I would have thought would have been more forward thinking! Is it so that in Australia there is not even civil partnerships yet? Very disappointed with all this.

    In an ideal world all children would be raised in a loving and understanding family. I would love if all children were raised in such a situation but there are lots of kids in need of a good home that provides love and attention and if two men or two women can provide such an environment I an sure that most children would welcome them with open arms.

  • It would also be wrong to read too much into this vote. Despite the fact that a clear majority of Australians support marriage equality, the political response is distorted by the fact that a so-called left/progressive PM is opposed – a view out of sync not just with the country but also the majority of her own party.

    The momentum continues to be on the side of marriage equality. New Zealand is mentioned in the article. France too will allow gay couples to marry in the next few months. In the UK, Cameron has promised equal marriage in this Parliament. And It will also happen here, hopefully sooner rather than later.

      You can doubt all you want but it doesn’t alter the facts – There is a growing political and societal consensus in favour of marriage equality. 73% support in the most recent survey, a figure that is growing all the time. Extending equality to same-sex couples is both the right and popular thing to do. And for younger people in particular, ending this archaic discrimination is a no-brainer.

    • Well hopefully we the citizens will vote on this matter and see then we shall see what the outcome is when it comes to the ballot box ;-)

    • In a Republic, all ‘citizens’ should be afforded equality..Whether a referendum is required or not has yet to be determined but if that is what it takes, I have every confidence in the fairness of Irish voters to not deny equal rights to their gay friends, family members, work colleagues etc. Between 2006 and 2011, support for marriage equality has jumped from 51% to 73% – the trend in public opinion is clear.

      But the human rights of a minority should not be up for a popular vote. And who got to vote on your right to marry a member of the opposite sex??…

    • All I was saying was that I doubted the change in the law would happen anytime soon in Ireland. Each to their own I say. Also if it went to a referendum I reckon it would be a lot closer then you think going by your figures

    Goodonya Oz…. BandaraBoy has hit the nail on the head above. It’s about the children. Gay marriage will not be the same as marriage in the eyes of the state, and nor should it be. I’m delighted to see this article this morning.

    • The anti-gay side is clearly losing the argument about the principle involved in allowing same-sex couples to marry, so they hope scaremongering around children will work. It’s the oldest trick in the book..But children are already being raised by same-sex parents and gay people can already adopt. But why should such families and their children be discriminated against because of the prejudices of a minority? The rights of children will be advanced when this reform is passed.

  • Well if it’s all about the children being adopted by gay couples lets ask the children or do not have a say in this when I put this to my 11yr old son the first thing he said was what about when the child goes to school It strikes me that same sex couples are only thinking of themselves and NOT the children

  • Disappointing yes , but I would not let that influence your decision to visit Australia at all , it’s a great country for to visit and at the moment and the whole world is grappling with the legal and political issues re equality for gay marriage , if you do go visit this makes NO DIFFERENCE to your trip , it only affects people who live there and want equality in a gay relationship

  • @shane so Shane can you please tell me how this story goes A same sex couple in this case man/man adopt a young girl say 6 or 7yrs old how do the same sex couple explain the birds and bees to her and get her through puberty because they will know all about this won’t they and then when she asks where is my mother (or should we get rid of mother and father and use a different term altogether) . And where is my father what will you tell her.

Any intelligent person would assume that if 2 gay men went to the effort to either adopt a child or use a surrogate would absolutely adore their daughter. The child with 2 adoring parents would be raised in a loving environment and would be happy. She also wouldnt think her situation abnormal as that would be the way she was raised. She probably wouldnt ask about a mammy until she was older and i would imagine 2 progressive gay dads would be proud to tell her of the efforts they went to to have a child.

      Your statements are both discriminatory against men and homophobic to boot. I sincerely hope no man ever sires a child on you!

    • You have now succeeded in not only insulting gay people and same-sex parents but also single parents and under family units that do not meet your narrow definition of what constitutes a ‘real’ family.

      All credible research in this area reveals that it is the quality of the parenting and not gender/sexuality that matters.

      And again, it comes down to this fundamental point – same sex couples and families exist and they and their children should not be discriminated against in law and certainly not because of the ridiculous and discredited reasons you have outlined above.

I bet those books don’t teach evolution the so-called “theory”. Dinosaurs also don’t fit in with the Catholic Church’s timeline of how old the earth is; therefore Dinosaurs didn’t exist.

      Gay marriage shouldn’t be an issue at all. There could even be a legal document (in case one dies and has no one to look after their children = adoption) which provides parents with the choice; of whether their kids are raised by: traditional parents, same-sex, or if both is okay with them. Problem solved for everyone, unless they are a bigot.
