Two teens convicted in rape case after assault went viral in US town

TWO US TEENAGERS have been found guilty of raping a fellow high school student – a case made notorious when a video of boys laughing about the assault on the “dead” drunk girl went viral.

Trent Mays, 17, and Ma’lik Richmond, 16, both high school football players in the small Ohio town of Steubenville, broke down when they heard the verdict on Sunday, which found them “delinquent beyond a reasonable doubt” on all counts.

Further charges may be brought against other people involved in the incident, which continued well after the 11 August assault as pictures and videos were shared via text message and uploaded to social media sites like Facebook.

“Many of the things that we learned during this trial that our children were saying and doing were profane, were ugly,” said Judge Thomas Lipps.

In one video, high school boys laughed about watching the rape, saying the girl “deserved to be peed on.”

Other videos and photos showed Mays and Richmond lifting the unconscious and nearly naked 16-year-old girl by her hands and feet.

Because they were tried as juveniles, the judge determined the verdict and the sentence, which the boys began serving immediately.

Richmond must serve a minimum of one year in a juvenile rehabilitation facility and a maximum of up until he turns 21, while Mays, charged with a second crime of “illegal use of a minor in nudity-oriented material,” was sentenced to a minimum of two years and a maximum of up until he turns 24.

They both apologised in court to the victim, her family and the community. Richmond said they had “no intentions” to commit the crimes, and Mays said “those pictures shouldn’t have been sent around, let alone even taken.”

Richmond’s father also apologised and asked for forgiveness for the boys for what he called “a terrible mistake.”

The 16-year-old victim was not in the room, but her mother addressed the court, telling the boys:

You displayed not only a lack of… compassion but a lack of any moral code.

“You were your own accuser through the social media that you chose to publish your criminal conduct on,” she said. “I have pity for you both.”

The girl’s lawyer, Bob Fitzsimmons, told CNN she was “doing well” and was relieved that the court case had finished.

“She’s a 16-year-old girl still, and she’s a high school student. She just wants to get back with her normal life, as does the family,” he said.

Repeatedly degraded the victim”

Ohio Assistant Attorney General Marianne Hemmeter said in opening statements last Wednesday that the two boys treated the girl like a “toy” and repeatedly degraded her by sending the photos to their friends.

Defense lawyers had disputed the prosecution’s assertion that the girl was too drunk to consent, and insisted the boys’ actions did not constitute rape.

The case has raised awareness of the power and danger of social media and cyber bullying, as sexually explicit or other humiliating pictures and videos spread like wildfire with a click of a mouse or a tap on a smartphone.

One in six US children aged 12 to 17 have received a sexually suggestive nude or nearly nude photo or video of someone they know, a recent study by the Pew Research Center found.

And the Crimes Against Children Research Center estimated that police investigated nearly 3,500 cases of youth-produced sexual images in 2008 and 2009.

    The sentences they were given were lenient to say the least, raping a young girl, recording the rape and then posting it online is no trivial matter, regardless of the age of the perpetrators.

    • Yes… Their sentence was very light considering the circumstances. However, the two lad’s life is practically over. Unless the lads have an inner strength to carry on. Please let me explain… Each lad will probably be in a juvenile prison near family until they reach 18. Then they will be moved to a regular prison once the reach 18. The prison have the rights to move them to another state away from family friends. Here they will sit until reach 21. Considering that the are now felons… They will be on paper for the rest of their lives. This means that the first four years or longer the will have a probation officer. They will be required to check in on regular intervals and take urine tests without question. The probation officer and the police can call on them whenever they like without fore notice. Furthermore, these lads are also now sexual deviants. Which means that they have notify the police when they move to let them know the location of their home. They will not be permitted to live near any schools, playgrounds any place people under 17 congregate.

      Additionally, when it comes to a job application they will have to mark that they are felons. Most companies do not feel comfortable hiring felons. Their probation officer is also required to review the place of hire to insure that the felon will not have a chance to re-offend or hurt others.

      Finally, the boys are on a national sex offender register. So anyone can check on their identity. Their lives are over.

The young girl they assaulted will most likely suffer the consequences of this for the rest of her life, she being the innocent party in this. I couldn’t care less how the lives of those boys are affected, but I hope the young girl has the strength and gets the support to at least try and have a normal life.

    • Elizabeth. .. I’m not saying these lads aren’t getting what they deserve. I believe it should be taken further and a civil suit should be taken against their parents being that in the US, parents are suppose to be held responsible for their child’s behavior.

      This money should go to the victim for rehabilitation.

    • I hear what you’re saying, the sentence isn’t as light as it seems. Accepted. But I still think it’s deserved. This girl has to live with this for the rest of her life. She will never get away from it. It will live inside her forever.

    • And rightly so, what about the pictures and video swirling around on the internet if this girl being raped, that will follow her around for the rest of her life aswell. She is also living a life sentence and has had her life destroyed, I have no sympathy for them and think they should have gotten harsher sentences, also while you may feel sorry for them and that their ‘lives are over’ having to register as a sex offender is not a violation it is protection for any other girl they may try to prey on.

I’m also happy that the nation has put pressure on the school, the city and the justice system to insure that usual “athletes can do no wrong” attitude would not fly. I am sick people getting preferential treatment because they belong to a certain family, club or group. These special peole always leave victims in their wake as they walk through life .

Her life and mind is destroyed. how anyone can even give a seconds thought to how these ANIMAL’S destroyed their own lives is beyond me.     • @Marlon. I think people are mistaking your description of their penalty for sympathy. You’re also right in saying that the American system is light years ahead of ours when dealing with sex offenders. However, people must ask themselves is it right to send these boys down the road of criminality? Failure to reform criminals only makes society more dangerous for everybody.

    • Gill-D… in no way am I sympathizing with the laads. They have gotten what they deserve. My explanation as to what awaited them is to show that their punishment isn’t lenient as a previous commenter stated. I was showing that these lads will carry this with them for the rest of their lives. There will be no where they can hide from this. Like the unfortunate victim, they will remember.

      You are correct… The registry is to protect others. I stated the registry because Americans take the registry very seriously. For example, in my home town a lad had consensual sex at 16 with his girlfriend. The girl admitted this. However, being that she was a minor her father had the case prosecuted since he was her guardian. The kid spent time in jail and when he got out his family took him in. Sadly, the family had to move 5 times because he’s on the registry. They now live 9n a farm somewhere.

      What’s my point… These boys lives are over. During a night of stupidy… They have ruined the lives of at least 3 families.

      What more could have been done to these boys?

    • Thanks for that John. You got my point! I agree with you. They will have counseling in prison along with the opportunity to continue their education. They will get assistance from psychologists to prepare them for the world so they will not re-offend.

      The difference between the American prison system is this…. Most prisoners are evaluated based on previous and current offenses. If the prisoner’s life id deemed salvageable then a small investment will be put towards the prisoner’s future outside of prison. The problem lies with habitat ual criminals and criminals that don’t have decent support. These people feed on more crime and bred more crime.

      All the issues that surround such a conviction, as listed by Marlon means these guys simply don’t have the life they were going to without this conviction. The custodial sentence appears lenient – I’d agree with that. I don’t think Marlon defended the sentence.

      The punishment for this crime goes well beyond the custodial sentence.

    • So what if they are? A girl is scarred for life: one of the defendants not only raped her but spread pictures of her and then lied about his involvement. These boys knew right from wrong (or should have). Keep your sympathy for that poor girl who has been physically and psychologically degraded by a pair of thugs.

    • Mary Kavanagh… I appreciate your anger. I angry too. Please reread my message. I wrote with relish that these lads will suffer far beyond their custodial sentences. My sympathy is definitely with the victim. Furthermore, my comment was to explain what generally happens in the US with rape convictions. Now saying this…. May I suggest you show your out rage and anger by supporting stronger consequences for rape victims here in Ireland.

      I can think of two rape cases here in Ireland were the gardie and court system was reticent about prosecuting the cases. Where the poor women had to move from the homes. Where the towns supported the rapists. In one case the parish priest came to the defense of one of the rapists.

      So Karen… Instead of accusing me of something that is untrue…. Maybe your words and voice can be better used to change how Ireland deals with rape.

    • Thanks Mary! I’m somewhat sensitive about such things and when I lived in America I fought very hard for freedom and justice. Much of need to fight was because I had a voice, an educated voice, that could be heard. My family’s history involves to many murders, rapes and unexplained deaths. Though society is changing in the US, it doesn’t diminish the pain my family has indured over the past century. Hence my passion for justice and fairness.

The original comment was explanation of what the lads are looking forward to for their crime. Some folks have stated on previous comments that tbeir one to two years in prison wasn’t enough time. Maybe not… However, American justice works much different then here in Ireland. My comment was detailing what was going to happen to them. Thus their lives are over!

  • As I understand this case, the 17 and 16 year old boys both raped a 16 year old girl who was so drunk she was basically unconscious, she then woke up the following day in a strange house missing her phone earrings shoes and underwear. She knew something was amiss but it was only when she began to her from friends about online videos that she realized the full extent of what had happened.
    These young men, and that is what they are, raped that girl. They provided they evidence for it themselves. To make a recording of such an act, and laugh about it, not only says a lot about their character but is a disgusting crime in itself. Then we come to how those pictures or videos were shared. Those who possessed and/or shared something that is so obviously itself a criminal act should be themselves prosecuted, and I don’t mean just a small fine, they should be prevented from ever doing something like that again for at least 10 years.

  • Not even close to enough of a sentence for this action. The fact that there were pictures/videos posted shows a complete lack of remorse for their actions, and if there’s a community where these guys thought it would be in any way appropriate to brag about this tells us a lot about the kind of young men they are, and the people they have around them.

    Every person who was aware of this and did not speak up should be charged as an accessory to this crime, as they basically facilitated the act!

    • An amendment in the US Constitution states that justice is fair and speedy. Considering the fact that the US is strict on all laws, courts are required for due process.

      In some states there is night court, weekend court, traffic court, juvenile court, civil court, ferderal court and supreme courts. With these courts come a lucrative prison system.

  • This is an extreme example of parents ot knowing what their children are doing.

    Though I hated it then… I really appreciate the fact that I had little privacy when I was gtowing up. My parents needed to know my friends, the parents of my friends, where I was going, time of arrival and time of departure. .. I often felt humiliated and embarrassed. As a teenager my parents permitted me get a license but they wouldn’t lend me tbeir cars or buy one of my own. So they happily chauffeured me and my friends around. This went on until I went to University.

    My parents made sure I understood. … As long as I was a minor and living under tbeir roof… I had to abide by their rules.

    I believe their rules saved my life. I am lucky… It couldn’t have been easy for my parents. It’s a shame that these boys didn’t have parents that were more involved. Because as I see it… They are also guilty.

  • So if you are 16 and 17 years old and commit such a heinous crime you more or less ok…few years in jail and your out,while victims ordeal will last a lifetime. It’s funny than when one is committing a crime he doesn’t care about the law,but when it’s time to face justice everyone wants everything to be done by the law.   • The two boys committed the crime, the girl was the victim. All of those who passed the photos and video around supported the act. Not one of them is currently the subject of legal proceedings.
    The sentence is 100% more advanced than what we have in this country, however, what we have in this country is a joke.

    There should be no leniency in society for the rape of a man or woman end of story. The whole Facebook side of the case is frightening.

    Laura Bates ( @Everyday Sexism ) is leading a campaign, part of it focusing on pages like the ‘Lad Bible’ where young males casually post & share jokes, pictures, pages, memes etc. basically taking the piss out of the crime of rape and sexual assault…it sounds harmless but there are sinister consequences.

    Moreover, I just can’t understand how the prosecution tried to dispute the fact she was too drunk to consent, at the time of the act she clearly was not an autonomous adult with full capacity…and her humiliation was recorded for fun? It defies belief.

    Whoever she is, she’s in my thoughts tonight.

  • Isn’t it about time that we start prosecuting rapes as hate crimes. Rapes and domestic abuse are all about men asserting their power over women. If an attack was carried out on somebody because of their race then they would receive harsher sentences. Racism is deplorable but attacks on women are widespread and are not viewed as an important issue. This is a global problem that has to be tackled now.

    As the alleged victim left the party with the two assailants, her (former) friend Anile, pleaded with her not to go with the boys.

    Anile stated: “I tried to pull her back, saying ‘let’s go.’ She swung her arm at me.” Showing a will to go with the boys.

    She picked up the alleged victim the next morning and accordingly the victim said “We didn’t have sex, I swear”.

    A fellow school student, Kelsey Weaver said the victim had been flirting with Richmond, one of the assailants at the party.

    Both Weaver and Anile testified that they were upset that night with the allged victim because she was drinking heavily.

    They testified that the victim had a history of drinking and lying about things in the past.

    • The fact that the victim was drunk does not excuse the actions of her rapists. Anyone with an iota of common sense and compassion would not have raped her, let alone take videos and photos and put them on the internet. This whole culture of making excuses for what is an horrific crime is sickening. The girl did nothing wrong; you cannot use ‘She was drunk’ as a legitimate get out of jail card, no more than ‘She was wearing a miniskirt and her boobs were showing’. Regardless of her condition, rape is rape. Just because she couldn’t say no does not mean she was willing to have sex with anyone that night.

    • If they were even close to decent individuals, they wouldn’t have even let her leave with them. Let alone do the tragic things they did to her.

      But you cannot disregard information as if it’s unimportant.

      I originally wanted them castrated and now I think they got the sentence they deserved, because I know more about the case. However. I expect people will treat them as equal to the vile gang rapists in India, which Is not justifiable in the slightest.
