Limerick City candidates raise fears ballot paper error could render constituency vote void

Candidates were not listed in alphabetical order, as is required by legislation.

VOTES IN THE constituency of Limerick City may be determined void before they are even counted, after it emerged candidates names did not appear in alphabetical order on some ballot papers, as required by legislation.

Clarity has been sought as to whether or not the votes will be counted at 9am, Saturday after the error on the ballot papers was noticed and first reported by the Limerick Post newspaper.

Candidates in the constituency also complained that polling cards did not reach some voters homes in some parts of the city.

Electoral law states that candidates must be listed on the ballot paper in alphabetical order, however Sinn Féin’s Maurice Quinlivan and Dean Quinn (The Irish People party) were incorrectly placed ahead of Willie O’Dea (FF) and Elisa O’Donovan (Social Democrats), on some ballot papers.

Candidates who may suspect their finishing position after the votes would be counted could be adversely affected by the error may be entitled to demand a re-vote, which could mean a prolonged delay in the result of the election.

Speaking on the issue tonight, incumbent Sinn Féin TD Maurice Quinlivan, said: “The whole election has been a fiasco, from the polling cards not arriving out to thousands of homes at all, and arriving very late in areas like Southill, only yesterday (Thursday).”

“A lot of people don’t understand they can vote without a polling card, and I’ve tried my best to alert people today, but that’s not my job, they should have been delivered much earlier than they were, and it’s been an absolute scandal,” said Quinlivan.

“The fact ‘they’ can’t get basic things right, like the alphabetical order of the candidates is an absolute scandal, and it is simply not good enough – this is a ridiculous situation to be in,” he said.

The Sinn Fein politician who topped the poll in the constituency in 2020 with 23.86% first preference votes said he did not know if a revote would have to occur.

“We’ll have to wait and see what the outcome of any legal challenges are to this, if there are legal challenges to this.”

“I assume it will be up to the returning officer, unless the courts intervene before 9am on Saturday morning, when the returning officer has to start the opening of the ballot boxes.”

“Obviously we are all going to be waiting on this. All of the candidates have worked really really hard for the last number of weeks to win as many possible votes, and our campaign teams are pretty tired at this stage, and to have this hanging over us now is simply not good enough.”

Quinlivan said candidates “need clarity on this…it’s probably better to get clarity rather than having to having challenges later on”.

“My understanding is that there have been very few electoral challenges in Ireland and I hope there isn’t one here in Limerick – but I would rather have clarity now than having this having over us for a longer time,” he said.

“At the moment I’m not minded to do any challenge, but a challenge might be made because it might suit us to have clarity, as opposed to have this hanging over us, and that might suit other candidates as well, just to have clarity.”

“And the returning officer would know, with a bit of legal certainty provided by the courts, before we open the ballot in the morning at 9am.”

“There is a High Court judge available 24/7,” added Quinlivan.

Outgoing Fianna Fáil TD candidate, Willie O’Dea, who has regularly topped the poll in the constituency, told the Limerick Post he was “stunned” by the error.

“A number of people said to me my name was quite far down the paper, but it was a busy day and I didn’t see the mistake,” said O’Dea.

“It’s absolutely unacceptable and I will be demanding to know on Monday who was it drew up the ballot layout and how this happened.”

The veteran Fianna Fáil politician agreed that the issue could overturn the election if taken to task.

If any candidate suffers as a result of a maring of several hundred votes, it is entirely likely that the result will be challenged on the grounds of the paper being wrongly drawn up.

Meanwhile, O’Dea also described as “a disgrace” the fact that many voters on the northside of the city failed to receive their voting cards.

“Half of the northside were left without any cards and people contacted me to say they went to the polling booths with ID to discover they were not on the register at all,” O’Dea alleged.

“It’s everyone’s democratic right to vote and it’s a disgrace that this could happen. I will want to know who is responsible.”

Limerick City Council was contacted but directed media queries to the Court Service which directed the queries to the returning officer for Limerick.

Efforts were made to contact the returning officer for Limerick by telephone and by email.

Efforts were also made to make contact with a number of other candidates in the constituency and they had not immediately responded.

    @Alan: Only received mine this afternoon, after I’d voted. Lots of friends didn’t receive one at all. I’m sure there’s plenty of people out there who didn’t know you can vote without it. Poor form, considering we’ve known for months that this election was coming.

    @Alex: And why would that be ? I’ve lived at the same address for 18yrs and never in that time have I not received a polling card until now. When I went to the polling station today I gave my name, had my ID in hand, explained no polling card had arrived and was just handed the voting form without the ID being looked at. Kinda odd.

    @Tommy Roche: its because yer name is on the register. the polling cards all arrived late this year…at a guess FG knew they were unpopular, hence why so many didnt go back for re-election. when you vote your name is checked off in the polling station. no one else then can vote again after that. no conspiracy at that level. after that who knows.

    @Alex: I received no polling card so I went to the same booth that I had previously voted in, and lo and behold there I was …. Voted no problem!

    I went to vote in Dublin..had my ID and Voting card..I was told I had already voted…which I hadn’t.. something fishy going on

    @Padraig O’Brien: yes it got me …. Took me 20mins to vote as I had to rearrange the alphabet in my head whilst trying to vote. As a man it’s very difficult to double task

    I voted last night, and I couldn’t tell you if the names of the candidates were in alphabetical order or not. I voted for the candidates per my preference. Regarding voting cards arriving late/not arriving at all, it’s everyone’s own responsibility to make sure they are 1)on the electoral register to vote.2)know the voting process(bring i.d , voting card not needed).. I can say with a good deal of confidence that if our airline travel tickets we booked online didn’t arrive a few days before our departure date, we would be on to the travel agent without delay. We would also not turn up at departures without our I.d… Take responsibility yourselves.

    I live in Limerick city, received our ballot cards weeks ago. Plus I knew I didn’t really need it as most times I’ve forgotten to bring it with me anyways. I’ve your going to be trusted to vote you should at least be capable of finding out that you don’t need a polling card.

    Wouldn’t matter where Willie’s name would be on the ballot paper, wouldn’t be putting a number beside it anyways, a journeyman politician, who runs with the Hare & hunts with the Hound. He came out with all kinds of criticism this year but then voted with Govt, hypocrisy, he wasn’t going to rock his gravy boat.

    I actually have a problem with political parties having access to the register and election information being posted to me by name by a Sinn Fein candidate using Dail Eireann stationery and franking. What’s the cost the taxpayer at a euro per letter postage and more importantly where’s my right to privacy.

    I received 4 invalid polling cards at my address. I brought them with me to the polling station and tried to give them to the person on reception. She refused to take them and proceeded to tell me what I needed to do. I told her that I left similar into the Council office after the last election and that I didn’t need to do anything, that her and her ilk had responsibility for maintaining the register accurately. She didn’t give a flying f!
