Specific part:

(3) A person who refuses or fails to comply immediately with a requirement of a member of the Garda Síochána under this section commits an offence and is liable on summary conviction to a class A fine or to imprisonment for a term not exceeding 6 months or to both.

So,failure to supply a specimen of breath when required is an offence in itself.(unless there is a specific,genuine reason why the specimen cannot be provided). Regardless of whether she provides a sample of blood/urine/breath at the station, a failure at the roadside is an offence.

Basically,refusing the roadside is a bad idea.

In fairness to Daly who clearly annoys a lot of people, she has said she will face the consequences if turns out she is over the limit. That is unlike the many people she exposed who get their penalty points wiped. The one case that struck me was of a person who was caught driving close to 100mph in a 100kmp/h zone. They had their points wiped, and were involved in a fatal traffic accident just a few months later.

It is reasonable to believe that the Guards released this as a way of hitting back at her for exposing the corrupt practices surrounding the use of points.

I would say at least she is admitting to it. But then she tried to minimise it by saying she had “just one hot whiskey for a cold”. One hot whiskey almost certainly would not put a healty adult over the drink drive limit.

We don’t know if Claire was over the limit. The guards released the information without saying if Claire was over the limit or without her being charged. They will go after her as much as they can because she speaks out about the wrong doings of the guards and others in the public sector. However Claire did say that she will take any punishments, to be commended I would say. She’s not running to a senior guard looking for them to be quashed like many public figures have.

They can’t tell how much alcohol she had in her system instantly through this method – so they have no idea if she was over the limit or not. She wanted to go the long way around it for whatever reason, rather than the quickest method.

Know it all Robin, I think you’ll find they only tell you if you give a breath sample. They can’t tell you if you give a urine sample until its tested by the medical bureau of road safety

I’m sure she’d have done a roadside breath test. If you’re over the limit on this, you get arrested and asked to give another sample at the station.

Roadside breath test is an indicator only. If you fail this you are brought back to the station to give another sample of breath, blood or urine. Not uncommon for someone to fail a breath test roadside and pass one back in a station.

Just a thought – if she had a cold, did she have a cough along with it? How hard is it to blow into one of those things? (I’ve never had to do one so I honestly don’t know) just wondering if it would impede the test, meaning a urine sample was more reliable?

Correct. My confusion is why it’s so prolonged. If she failed roadside test, then it’s into the station for intoxiliser or blood/urine. Her comments suggest she is seeking media attention unless its the latter, otherwise the intoxiliser presents results pretty much instantly.
