Third Delhi gang-rape suspect to plead not guilty: lawyer

The suspect will plead not guilty to all charges, his lawyer said, claiming the two other suspects would also plead not guilty.

A THIRD SUSPECT accused of fatally gang-raping a 23-year-old student in a moving bus in New Delhi last month will plead not guilty to all charges, his lawyer said today.

Advocate ML Sharma said he would file the plea on behalf of Ram Singh, the driver of the bus where the attack allegedly took place which has fuelled angry protests across India.

“I am representing Ram Singh and I will file a ‘not guilty’ plea,” Sharma, who is also representing Singh’s brother Mukesh and labourer Akshay Thakur in the case, told AFP.

The advocate said yesterday that the other two men would also plead not guilty to the string of charges including gang-rape, murder and kidnapping.

He said:

Whoever committed this heinous crime should be punished but my clients are not the real culprits.

It is not yet clear who will represent the two remaining defendants. All five men are residents of New Delhi slums aged from 19 to 35. A sixth accused, who is 17, is to be tried in a separate court for juveniles.

Officials at Tihar jail, the maximum security prison where the accused are held, confirmed that Sharma had met Ram Singh late on Tuesday.

Prosecutors have said they have evidence of bloodstains linking the men to the attack, but the advocate said he would challenge the police over their handling of evidence, while refusing to give details.

The next hearing, to be held behind closed doors, has been scheduled for tomorrow, when a magistrate is expected to transfer the case for trial in a special fast-track court.

The brutal attack on the medical student and her boyfriend has stirred anger in India, with politicians and the murder victim’s family calling for the death penalty for the culprits.

The pair had been to watch a film when they were lured onto a bus. The gang are accused of repeatedly raping and violating the woman with an iron bar, causing horrific internal injuries.

    • Hopefully justice and those who are responsible are brought to justice. However it seems legal systems that are under the international eye tend to fall apart. Hopefully this wont happen here

    • @ kaja ..,, he already identified them as the ones who carried out the crime . Considering he was trapped on the bus with them for well over a hour I think he should know !
      They are truly cowardly savages !

    The poor girls family. How do you cope with losing a loved one in these extreme disgusting circumstances. Id lose my mind if it happened in my Family. Makes me feel ill just thinking of it. The men responsible for this did not behave like human beings, they should not be treated like human beings.

  • Let them plead not guilty it will only make the sentence worse for them. How will their defence team explain her blood on their clothes and the fact that the boyfriend can identify each one of them. I actually felt sorry for the legal team who had to stand for these men, ehhh not anymore!!

    • @Rachael, blood won’t prove rape. Even boyfriends witness statement will be challenged and made appear in-concise. And the rape with the iron bar will be questioned as who is to say which perpetrator inflicted a fatalistic action after initial rape? Two will be found guilty of sexual crime, no one of murder and the rest will get minimum time and juvenile will walk. Already, two of them have turned states witness…NO justice will be done here.

  • The Govt feel they have played their part and have handed this over to judiciary to become a bigger circus. The govt have given the family 14k€ (10 lakh) and a family member a govt job as a sop to their loss. The court case is already on thin ice as media speculation has been allowed to interfere with due process. The not guilty plea will highlight an inept evidence trail and once again Delhi police will be on trial(and rightly so) but that will not afford too much comfort to the victims family. The presumption of innocence for the alleged rapists is already farcical as three of their family ‘homes’ have been ransacked, partially burnt or totally destroyed. Several family members have been attacked. The girls name will be dragged through the mud and all so the Govt can be seen to be humane and law abiding when behind closed doors the majority of the Lok Sabha believe she shouldn’t have been wearing a skirt!! TII…This Is India!
