Assault case against barrister Diarmuid Phelan adjourned until June

Applying for the adjournment, Phelan’s barrister said a defence witness had been unavailable.

A JUDGE HAS adjourned an assault case against a law professor and senior counsel at Wexford District Court until June.

Diarmuid Phelan, also known as Diarmuid Rossa Phelan (56), who lectures in Trinity College, was charged with assaulting Kevin McHale at Reedstown, Tacumshane, Co Wexford on 26 August 2021, causing him harm, contrary to Section 3 of the Non-Fatal Offences Against the Person Act.

Phelan, who was not present in court this morning, was represented by Lisa Cloney.

The case came before Judge John Cheatle.

The case had been adjourned to this morning but Cloney said a defence witness was unavailable and applied for a further adjournment

Sergeant Victor Isdell said there was no objection to the application. He requested that a special date should be fixed for hearing, the case taking half a day.

Judge Cheatle agreed to a further adjournment and set a special day of 30 June for hearing. He added that a judge would be assigned to hear the case.

At an earlier hearing, the District Court had accepted jurisdiction after the Director of Public Prosecutions said the assault could be heard at District Court level.

The accused was remanded on continuing bail. A condition of the bail is that the accused must have no contact, direct or indirect, with the injured party.
