Garda Ombudsman Commission rejects claim it overstepped its powers

The Garda Representative Association says the Garda Ombudsman Commission displayed “excessive and oppressive behaviour” during a recent investigation.

THE GARDA OMBUDSMAN Commission has rejected a claim that its investigation into the alleged misconduct of a garda was excessive and oppressive.

The Garda Representative Association (GRA) had questioned the legal authority of a number of the Ombudsman’s investigators, as well as the manner in which they conducted their investigations, in relation to the case of Garda Brendan Whitty, RTÉ reports.

Whitty is back on duty after being acquitted of assault following a six-day trial.

The GRA says that it received a complaint from a garda witness about the behaviour of two members of the Ombudsman Commission – and that it will be writing to the Director of Public Prosecutions about the matter.

Damien McCarthy, President of the GRA, told Newstalk’s The Last Word that gardaí were worried about facing similar trials if they use their batons or incapacitant spray.
