Assault case further adjourned against law professor and barrister Diarmuid Phelan in Wexford

Diarmuid Phelan, also known as Diarmuid Rossa Phelan, (56) is charged with assault of a man.

A JUDGE HAS further adjourned an assault case against a law professor and senior counsel for assault at Wexford District Court.  

Diarmuid Phelan, also known as Diarmuid Rossa Phelan (56), who lectures in Trinity College, previously appeared before Judge John Cheatle on a charge of assaulting Kevin McHale at Reedstown, Tacumshane, on August 26, 2021, causing him harm, contrary to Section three of the Non-Fatal Offences Against the Person Act, in a case brought by Garda John Coughlan.

The case had been adjourned to this morning for Judge Miriam Walsh to fix a date for a District Court trial. 

Tim Cummings, solicitor for the accused, said today that he would need a day’s adjournment as there had been a mistake with the date.

Judge Walsh agreed to the further adjournment and a date will be set tomorrow for a day long hearing. 

At an earlier hearing the District Court had accepted jurisdiction after the Director of Public Prosecutions said the assault could be heard at District Court level. 

A condition of bail is that the accused must have no contact, direct or indirect, with the injured party.
